El teletrabajo como herramienta administrativa y asistencial en la gestión pública del sector salud en Perú

El presente artículo tiene como objetivo analizar los principales desafíos del teletrabajo y la teleasistencia aplicados al personal administrativo y asistencial del sector salud peruano, considerando su impacto en la protección laboral y en la organización del servicio. El objeto se centra en las implicancias legales que surgen al trasladar actividades sanitarias a modalidades remotas. La metodología, de enfoque cualitativo, de tipo básica y de nivel descriptivo reflexivo, desde el estado del arte, se basa en la revisión de la literatura, lineamientos institucionales y estudios especializados que permiten interpretar cómo estas prácticas se desarrollan en el contexto nacional. Los resultados muestran vacíos normativos en aspectos como supervisión, jornada laboral, disponibilidad digital, protección de datos sensibles y condiciones ergonómicas, así como tensiones entre eficiencia operativa y garantías laborales. En conclusión, se evidencia la necesidad de actualización y armonización de derechos ínsitos en el tele trabajo y tele asistencia, brindando mayor seguridad y fortalecimiento a una gestión pública de servicios de salud en Perú.
This article aims to analyze the main challenges of telework and telecare applied to administrative and healthcare personnel in the Peruvian health sector, considering their impact on labor protection and service organization. Its focus is on the legal implications arising from the transfer of healthcare activities to remote modalities. The methodology, with a qualitative approach, basic type, and descriptive-reflective level, is based on a state-of-the-art review of the literature, institutional guidelines, and specialized studies that allow interpreting how these practices develop in the national context. The results reveal regulatory gaps in aspects such as supervision, working hours, digital availability, sensitive data protection, and ergonomic conditions, as well as tensions between operational efficiency and labor guarantees. In conclusion, the need to update and harmonize the inherent rights in telework and telecare is evident, providing greater legal certainty and strengthening public management of health services in Peru.
